Terms of Service

SMS terms

Nous sends text messages for sign-in codes, and a single invite text when a member invites you in person at an event. By entering your number and tapping Send code, you agree to receive a sign-in code by text.

Messages

One-time sign-in codes, for example: “Nous code: 123456. Never share it. Nous will never ask for it.” If a member invites you in person at an event, a single text with your invite link. We do not send marketing or promotional texts.

Consent

You consent to sign-in texts by entering your U.S. mobile number in the Nous app and tapping Send code. You consent to an invite text by giving your number to the member who invites you, who enters it in the app.

Frequency

Message frequency varies. You get a sign-in text only when you request a code. An invite is one text, sent only when a member at the door enters your number.

Opt out

Reply STOP to opt out at any time. Reply START to resume.

Sharing

Mobile information (phone numbers) and SMS opt-in and consent are not shared with or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Texts are sent to U.S. numbers only. Carriers are not liable for delayed or undelivered messages. A sign-in code is required to use Nous, so after replying STOP you cannot sign in until you reply START.

Members may send an invite only to someone they know, with that person’s permission. Support: support@nous.party.

Eligibility

• You must be 18 or older. Some events are 21+, as stated on the event.
• You need a U.S. mobile number.
• Membership is by invite, or during open sign-up periods.
• You may have one account, and each ID may verify only one account.
• The information you provide, including your age and identity, must be accurate.

Your account

• Keep your sign-in codes private. We will never ask you for one.
• You are responsible for activity on your account and your phone.
• Passes are personal and may be used only by you. Door staff may check that you match your photo.
• You can delete your account at any time in the app.

Events and passes

Events are run by independent hosts and venues, not by Nous. They set their own rules, including age limits and capacity. A pass does not guarantee entry, and hosts, venues or door staff may refuse entry to anyone.

We keep a record of the events you attend and miss. That record can affect your standing, including your invites and your ability to host.

Community rules

• Treat other members, hosts and door staff with respect. No harassment, threats or hate.
• Do not impersonate anyone or use another person’s ID or phone.
• Your profile content must be yours to share and must not be sexually explicit, hateful or illegal.
• Do not sell or trade invites or passes.
• Do not scrape, probe, or attempt to bypass the Service’s security or limits.
• Do not use invites to text people who have not agreed to it.

You can report a member from their profile. We may remove content, or limit, suspend or close accounts that break these rules.

Your content

You keep ownership of your profile content. You give Nous permission to display it to other members, hosts and door staff as needed to operate the Service.

Disclaimers and limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind. Attending events involves risk, which you accept. To the fullest extent permitted by law, Nous is not liable for events, for the conduct of members, hosts or venues, or for any loss caused by the Service being unavailable or inaccurate. Nothing in these terms limits liability that cannot be limited by law.

Termination

You may stop using the Service at any time. We may suspend or close an account that breaks these terms or puts others at risk.

Changes to these terms

We may update these terms. We will update the effective date above. Continuing to use the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the United States and of the state in which Nous is operated.
